Functions
The State Consumer Disputes Redressal Commission is a creation of Consumer
Protection Act, 1986 which is a Central Legislation. The Act provides for a
better protection of the interest of Consumers and for that purpose to make
provisions of the establishment of Consumer Councils and other authorities for
the settlement of Consumer’s disputes and for matters connected therewith. The
State Commission shall consist of a person, who is or has been a Judge of a High
Court, appointed by the State Govt., who shall be its President and not less
than two, and not more than such number of members, as may be prescribed, and
one of whom shall be a woman. The qualifications for the appointment of Members
have been prescribed under Section 16 of the Consumer Protection Act, 1986.
Subject to the other provisions of this Act, State Commission has jurisdiction
to entertain (a) complaints where the value of goods or services and
compensation, if any, claimed exceeds 20 lacs but does not exceed Rs. 1 Crore
and (B) appeals against the orders of any District Forum within the State and
(c) to call for the records and pass appropriate orders in any consumer dispute
which is being pending before or has been decided by any District Forum within
the State, where it appears to the State Commission that such District Forum
exercised a jurisdiction not vested in it by law, or has failed to exercise of
its jurisdiction illegally or with material irregularity. Thus, the State
Commission has original, appellate and revisional jurisdiction. Besides the
above, the State Commission has administrative control over all the District
Consumer Forums in the State of Punjab as provided under Section 24-B of the
Consumer Protection Act. In addition the President of the State Commission is
Head of the Department and as such performing all administrative functions also.
Similarly, each of the District Consumer Forum shall be consist of a person, who
is or has been, or is qualified to be a District Judge, who shall be its
President and two other Members, one whom shall be a woman. The qualifications
for the appointment of Members has been given in Section 10 of the Consumer
Protection Act. Subject to other provisions of this Act, the District Forum
shall have jurisdiction to entertain complaints where the value of the goods or
services and the compensation, if any, claimed does not exceed Rs.20 lacs.
Section 11 of the Act deals with the Jurisdiction of the District Forum.

Decision on consumer complaints |
For the decision of complaints/ Appeals/ Revisions, no specific time
can be given. However, under the Consumer Protection Act, the complaints
etc. are required to be decided within 90/150 days from the date of
service on the opposite party. Besides the above a consumer Forum is
expected to dispose of at least 75 to 100 matters per month. |
